Terms of Service
Last Updated: August 2026 | Effective Date: August 25, 2026
1. Scope of Professional Advisory Services
The Commercial Licensing Authority operates as an independent commercial liquor licensing consultancy and document facilitation agency. Our services comprise regulatory eligibility assessments, statutory application dossier preparation, municipal town planning coordination, public participation notice administration, and liaison with relevant licensing boards.
2. Statutory Disclaimers & Non-Guarantee of License Approval
Crucial Notice: We are a private professional consultancy and are not a government entity, provincial liquor board, or municipal authority. The statutory power to grant, decline, transfer, or renew liquor licenses resides exclusively with the competent provincial liquor board or local licensing committee having jurisdiction.
While we apply rigorous legal, procedural, and zoning standards to ensure applications comply fully with statutory mandates, we cannot and do not guarantee the final outcome or issuance of any license by regulatory authorities. Regulatory approval timelines and decisions remain solely within the discretion of government bodies.
3. Client Responsibilities & Accuracy of Information
Clients are solely responsible for ensuring that all documentation, plans, lease agreements, CIPC declarations, and disclosures provided to us are truthful, accurate, and up to date. The submission of fraudulent, invalid, or altered documents will result in immediate termination of services and may incur statutory criminal liability under the South African Liquor Act and provincial regulations.
4. Professional Fees, Disbursements & Payment Terms
Consultancy fees, professional drafting charges, and statutory government application disbursements (including municipal inspection fees, board application fees, and statutory newspaper notices) are governed by the specific formal quotation or service agreement executed prior to commencement. Unless otherwise stated in a written mandate, statutory government disbursements and advertising fees are strictly non-refundable once committed to third-party vendors or licensing boards.
5. Limitation of Liability
To the maximum extent permitted by South African law, The Commercial Licensing Authority, its directors, consultants, and agents shall not be held liable for any indirect, consequential, or economic losses, including loss of business revenue, lease cancellation costs, or operational delays arising from municipal zoning disputes, community objections, public hearing postponements, or regulatory processing delays beyond our operational control.
6. Governing Law & Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the South African courts having competent jurisdiction in the Gauteng province.
